1. Agreement and service
These Terms of Use apply to tools.fmppt.com and FieldCheck, including the report builder, templates, guides, and exports (the “Service”). By using the Service, you agree to these terms. If you use it for an organization, you represent that you are authorized to accept these terms for that organization.
FieldCheck is currently a free, browser-based tool. We may improve, change, suspend, or discontinue features. If paid features are introduced, their price and additional terms will be shown before purchase; these terms do not create a future payment obligation by themselves.
2. Appropriate use
You may use the Service to create lawful inspection, punch, snag, property, rental, and related reports. Do not use it to violate privacy, trespass, evade required notice or consent, infringe intellectual-property rights, distribute malware, attack the Service, bypass access controls, or create unlawful or deceptive records.
You are responsible for site access, safe working practices, authorization to inspect or photograph, accuracy of your entries, and lawful distribution of the resulting report. Do not enter unsafe areas or perform tests you are not qualified and authorized to perform.
3. Your content and local data
You retain responsibility for the project details, text, photos, and other content you place in the tool. You must have the rights and permissions necessary to use, process, export, and share that content. In the initial local-first workflow, report content is processed and may be autosaved in your browser rather than an account-based FieldCheck project.
You are responsible for backups, retention, access control, deletion, and recipient review. Browser data can be lost through clearing, device failure, profile changes, or software behavior. Export PDF, JSON, or CSV and store required records in an appropriate system. We are not a custodian of locally stored report content and generally cannot recover it for you.
4. Reports are aids, not professional determinations
The Service organizes information you provide. It does not inspect a property, verify a photo, diagnose a cause, determine responsibility, certify compliance, establish contractual completion, value a claim, authorize entry, or decide whether a rental condition is ordinary wear. Templates and guides are general educational materials, not legal, engineering, architectural, building-code, safety, environmental, insurance, tax, or other professional advice.
Use qualified professionals, required tests, current laws and standards, project contracts, manufacturer instructions, and formal notice procedures where applicable. You remain responsible for reviewing every exported report before relying on or distributing it.
5. FieldCheck materials
The Service software, design, branding, and editorial content are protected by applicable intellectual-property laws. You may use ordinary report outputs for your personal or business inspection work. You may link to our public guides and templates. Unless permitted by law or written permission, do not copy the Service as a competing product, scrape it at scale, remove notices, or imply endorsement or affiliation.
Feedback may be used to improve the Service without obligation to you, provided we do not claim ownership of your underlying confidential report content merely because you described a workflow or problem.
6. Availability and disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT PROMISE THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, SUITABLE FOR A PARTICULAR PROFESSIONAL OR REGULATORY PURPOSE, OR THAT LOCAL AUTOSAVE OR EXPORT WILL PREVENT DATA LOSS.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you. Nothing in these terms excludes rights that cannot lawfully be excluded.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDCHECK AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, REVENUE, BUSINESS, OPPORTUNITY, OR GOODWILL ARISING FROM THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM THE FREE SERVICE WILL NOT EXCEED USD 100. These limitations do not apply where prohibited and do not limit liability that cannot legally be limited, which may include liability for fraud, willful misconduct, or certain personal injury depending on applicable law.
8. Changes, severability, and contact
We may update these terms as the Service changes. The effective date above identifies the current version. Material changes will be presented through a reasonable notice on the Service. Continued use after the new terms take effect constitutes acceptance where permitted by law.
If a provision is unenforceable, it will be limited or removed to the minimum extent necessary while the remaining terms continue. These terms do not override mandatory consumer or other statutory protections that apply to you. Questions can be sent to support@fmppt.com.
